Why it needs to be updated and how its costing Michigan millions of tax dollars.


Our judicial system is primarily good, but our laws are too vague and the legal system has spiraled out of control in many ways. This is where many good, honest, law abiding, hard working individuals get burned. Now, I am not saying that everyone that the police or investigators arrest are not guilty, but what I am saying is that too many people that are not guilty are having to spend a lot of money, time and effort trying to prove their innocence. Citizens can be charged and prosecuted for something they didn’t do because of the way our legal system is allowed to operate. We need to fix this because the saying, “Your innocent until proven guilty,” was not supposed to cost you, and it really shouldn’t. THIS NEEDS TO CHANGE.
For too long many of Michigan's citizens have been treated as if they were less than equal, from a disrespectful, ego sporting police officer who pulled you over to a court appointed attorney who appears to be more interested in convincing you to plead guilty to a lesser charge than going to trial and proving your innocence. There are many areas of the legal system that need attention One by one, "Itsmymichigan.com" plans to review them and advocate for changes that will both help protect Michigan residents as well as potentially save its’ citizens millions of dollars.
One area, for example, that needs our attention is the laws’ ability to protect the innocent right from the start. The following proposed changes would allow this to happen as well as keep police and/or detectives from informing the accused person of key information pertaining to their case, which could later be used against them during any court proceedings. In addition, it will protect the accused individual from being threatened with long prison terms in an effort to coerce him or her into admitting to a crime they haven’t committed or, in most cases, to a lesser charge.

  When the police or detectives respond to a “complaint,” (i.e. an accident, breaking and entering, domestic assault, etc.) no matter what, they can only respond to and report on the “complaint” and what they have witnessed themselves as well as collect any evidence, whether material or by other eye witnesses. If there is an arrest at or near the scene, the police must read the accused person their rights but cannot ask any questions nor can that person be interrogated by anyone until their attorney is present and had time to advise the arrested individual. As soon as the person is arrested and brought to the station for processing, the officer must give the individual the ability and means to obtain an attorney of their choice as well as a call to a family member to inform them of where they are and the circumstances they are in. If this case goes to court and the individual is found innocent, the city/county would be responsible for paying all attorney fees, court costs, and for the time that this individual has been disrupted. All files pertaining to that case would be given back to the individual or destroyed, any pertinent information would be removed from any records and a letter of apology for any wrong doing from the city/county would be given to that person.
